My name is Rob Hurley.  I have been a Chicago divorce and family law attorney for over 25 years.

Everyone who is considering a divorce has two important questions:  1) How much is this going to cost me? and 2) How long will it take before I am divorced?


CONTESTED DIVORCE:  I charge by the hour for my services.  I will ask you, as my client, to pay a retainer for my services to begin work on your case, and then I will bill you by the hour for my work, deducting the fees from your retainer as I earn them.  The total amount that I will charge you for a contested divorce will depend on how many hours of work are required for me to bring your case to a conclusion.  This will depend on many factors, including the complexity of the issues and your spouse’s willingness – or stubborn refusal – to negotiate a settlement.  However, it is my goal to provide you, my client, with low-cost divorce services, so I will always do my best to complete your case as efficiently, quickly and inexpensively as possible.  My many years of experience as a family law attorney help make it possible me to achieve this goal for you.  I know the law and what is, and what is not, legally possible, and I will advise you accordingly so that we do not waste time and money on objectives that we cannot accomplish.  I am a trained mediator, so I possess the negotiation skills necessary to reach a reasonable settlement of your case, if settlement is at all possible.  And, when necessary, I am a tough litigator and an experienced trial attorney who will fight hard to accomplish your objectives if we cannot settle your case and must go to trial.

UNCONTESTED DIVORCE:  I can quote you a flat fee for your divorce if it is clear that it will be a simple, uncontested divorce, which means that you and your spouse have agreed to all the terms of the divorce, including child custody, child support, visitation, property division, payment of debts and any and all other issues.  Otherwise, if there are any contested issues, I will charge you by the hour for my services as I’ve described above.


The answer to this question is very similar to what I wrote above about the total cost of your divorce.  The length of time that it will take to finish your case will depend on the complexity of the issues and your spouse’s willingness or unwillingness to negotiate a settlement.  If child custody and/or visitation are issues in your case, if we must engage in discovery to find all of your marital assets so that the Court will award you all of the property to which you are entitled, if your spouse engages in delay tactics, if your case must go to trial because we cannot settle the case, or if any number of other difficulties arise in your case, then it can take many months or longer to bring your case to a conclusion.  However, once again, my goal is to provide you with low-cost divorce services, so I will always do whatever I can to bring your case to a just conclusion as quickly and as inexpensively as possible.
